These Terms of Use govern your access to and use of eMathSmart, an online learning service offered by Popular Book Company (Canada) Ltd. (“Popular Canada”, “we”, “us” or “our”).

By creating an account, starting a free trial, purchasing a subscription, or using eMathSmart, you agree to these Terms of Use.

1. Parent or Guardian Account

eMathSmart is designed as a learning service for children, with the subscription and account managed by a parent or legal guardian.

The parent or legal guardian creating the account is responsible for managing the account, maintaining the confidentiality of account login information, and supervising the child’s use of eMathSmart.

By creating a child profile or allowing a child to use eMathSmart, you confirm that you are the child’s parent or legal guardian, or that you otherwise have the legal authority to provide the required consent on the child’s behalf.

2. eMathSmart Service

eMathSmart provides digital math learning resources which may include interactive exercises, printable worksheets, learning videos, math tools, educational games, AI-assisted worksheet checking, AI-assisted learning support, assessments, and parent learning reports.

Features and content may be added, modified, updated or removed from time to time as we improve the service.

eMathSmart is intended to supplement a child’s learning and is not a substitute for instruction from a qualified teacher or educational professional.

3. Account Requirements

A valid Parents’ Club account is required to access eMathSmart.

When an eMathSmart account is created, the account holder may also become a member of Popular Canada’s Parents’ Club in accordance with the applicable Parents’ Club terms.

You agree to provide accurate and current account information and to keep your account information secure.

4. Subscriptions and Free Trials

Certain eMathSmart features require a paid monthly or annual subscription.

Eligible users may receive a free trial. Unless the subscription is cancelled before the trial period expires, the payment method provided during signup will be charged the applicable subscription fee plus applicable taxes when the trial ends.

Subscriptions automatically renew until cancelled.

5. AI Features and AI Coins

Certain eMathSmart features use artificial intelligence to provide educational assistance, including worksheet checking and responses to math-related questions.

AI-generated results may not always be complete or accurate. Parents and students should review AI-generated information and should not rely on eMathSmart AI features as the sole source for educational assessment or instruction.

Certain AI features use eMathSmart AI Coins. Applicable Coin allocations, usage rates and optional Coin purchases will be displayed within eMathSmart or at the time of purchase.

AI Coins have no monetary or cash value outside eMathSmart and cannot be exchanged for cash.

6. Student Content and Worksheet Uploads

eMathSmart may allow users to upload completed worksheets or other educational content for processing and feedback.

You are responsible for ensuring that content uploaded through your account is appropriate for use with the service and does not contain unnecessary personal information.

Uploaded material may be processed by systems and service providers used to operate eMathSmart, including systems supporting AI-assisted features, as described in our Privacy Policy.

7. Acceptable Use

You may use eMathSmart only for personal, non-commercial educational purposes.

You may not:

• copy, reproduce, distribute or resell eMathSmart content except where expressly permitted;
• share your account with individuals outside your household except where expressly permitted;
• attempt to gain unauthorized access to the service or another user’s account;
• interfere with the operation or security of the service;
• use automated systems to scrape, extract or reproduce eMathSmart content; or
• use eMathSmart content to train artificial intelligence or machine-learning systems without written authorization from Popular Canada.

8. Intellectual Property

All eMathSmart content, including text, exercises, worksheets, videos, illustrations, graphics, software, trademarks and other materials, is owned by or licensed to Popular Book Company (Canada) Ltd., and is protected by applicable intellectual property laws.

Your subscription provides you with a limited, personal, non-exclusive and non-transferable right to access and use eMathSmart while your subscription is active.

9. Availability of the Service

We work to keep eMathSmart available and functioning properly but cannot guarantee uninterrupted or error-free access.

Temporary interruptions may occur for maintenance, technical issues, updates or circumstances beyond our reasonable control.

10. Suspension or Termination

We may suspend or terminate access to eMathSmart where an account is used in violation of these Terms, where payment is not successfully completed, where misuse or fraudulent activity is suspected, or where required by law.

11. Privacy

Our collection, use and disclosure of personal information in connection with eMathSmart is governed by the Popular Book Company (Canada) Ltd. eMathSmart Privacy Policy.

Because eMathSmart is designed for children, a parent or legal guardian is responsible for providing any consent required for the collection and use of a child’s personal information.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes to eMathSmart, our business practices or applicable laws.

Where a change materially affects your rights or the way the service operates, we will provide reasonable notice where required.
